The Omaha Jail Release Process
Normally, when someone is arrested on a misdemeanor, a bond is set according to a set schedule at the jail. For instance, for an out of state residence that is arrested for a DUI in Omaha, then bond is set $5,000 and that person will have to post $500 to get out of jail. There is a schedule for various circumstances that will determine the “scheduled bond”.
For felony DUI arrests in Omaha, the person will normally have to wait to see Judge to set bond. Sometimes very high bonds are set. Many people get arrested over the weekend and have to see a Judge on the next business day. We might be able to speed this process up.

There are circumstances where we can reach a prosecutor, explain the circumstances and reach an agreement on bond. If we are successful, the prosecutor will call on on-duty judge who will set the bond. Bonds can range from a dollar amount to release without posting a bond.
There is no guarantee that we will be successful at getting a bond set on a non-business day. Sometimes, the facts of a case prevent agreement on what is appropriate and sometimes we cannot reach the appropriate parties during non-business hours. However, we have successfully achieved freedom in many cases.
If we are not successful at off hours bond setting, then we will appear at the next-business day bond setting and present your case. Since we have already met with you in jail, know your case and have possibly had time to investigate certain aspects, chances are that reasonable terms of release will be obtained.
